SMS Terms & Conditions

These SMS Terms and Conditions ("SMS Terms") govern the text message communications sent by HeyJessica ("we," "us," or "our") as part of the HeyJessica daily check-in service. By personally enrolling and providing your mobile phone number on our enrollment form, you agree to these SMS Terms.

1. Program Description

HeyJessica is an AI-powered daily check-in and companionship service. Enrolled users receive friendly daily SMS messages, conversational replies to messages they send, and reminders they have personally configured (such as medication or appointment reminders). Account administrators may also receive SMS service notifications related to their active subscription.

Messages sent by HeyJessica are part of a personal companionship service. We do not send marketing or promotional messages. All messages are conversational, transactional, or service-related.

2. Mobile Information & Privacy

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing to subcontractors (such as our SMS delivery providers) for the sole purpose of providing the messaging service is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

3. How Consent Is Obtained

HeyJessica only sends SMS messages to a phone number after the owner of that phone number has personally enrolled. The enrollment process is:

  • An account administrator (an adult family member) signs up at heyjessica.ai and provides the email address of the family member they wish to enroll. They never provide that family member's phone number.
  • The family member personally receives an email containing a unique single-use link to a web-based enrollment form.
  • On their own device, the family member personally enters their own mobile phone number and checks an unchecked consent checkbox affirming: "Yes, I agree to receive recurring SMS text messages from HeyJessica, including daily morning check-ins, friendly conversation, and appointment reminders. Message frequency varies (typically 1-3 messages per day). Message and data rates may apply. Reply STOP to unsubscribe at any time, or HELP for help. Consent is not a condition of any purchase."
  • Consent is captured server-side with a timestamp, IP address, user agent, and the verbatim consent text shown on the form. This record is retained for compliance audit purposes.
  • No SMS messages of any kind are sent to a phone number until that person has personally completed the enrollment form on their own device.

Account administrators receive transactional service notifications related to their active subscription (account changes, billing notices, missed check-in alerts) by separately opting in during account setup.

4. Message Frequency

Message frequency varies, typically 1 to 3 messages per day. Frequency depends on the conversational activity initiated by the enrolled user, the reminders they have configured, and any service notifications related to their account. Account administrators may receive additional messages on days when alerts are triggered.

5. Message Content

Once enrolled, recipients receive:

  • Daily morning check-in messages
  • Conversational replies to messages they send
  • Reminders the recipient has personally configured (medication, appointments, birthdays)
  • Occasional service messages (account changes, opt-out confirmations)

All messages are sent with clear identification as HeyJessica. We do not send marketing or promotional messages.

6. How to Opt Out

You may opt out of receiving SMS messages from HeyJessica at any time by replying STOP to any message. Opt-out is honored immediately and permanently for that phone number. Upon receiving STOP, we will send one final confirmation message and then cease all SMS communications to that number.

If the account administrator's phone number opts out, daily check-ins for that account will be suspended and the administrator will be notified by email.

To re-enable SMS messages after opting out, reply START to any previous message from HeyJessica, or complete the enrollment form again.

8. Message and Data Rates

Message and data rates may apply to all SMS messages sent and received as part of the HeyJessica service. These charges are applied by your mobile carrier and are not collected by HeyJessica. Contact your mobile carrier for details about your messaging plan.

9. Supported Carriers

HeyJessica's SMS service is available on all major US carriers including AT&T, Verizon, T-Mobile, and most regional carriers. Carrier support is not guaranteed for all carriers. HeyJessica is not liable for delays or failures in message delivery caused by carrier issues, network outages, or device limitations.

10. Eligibility

You must be at least 18 years of age and a US resident to enroll in the HeyJessica SMS service. By enrolling, you confirm that the mobile phone number you provide belongs to you and that you have the authority to consent to receive SMS messages on that number.

11. Changes to These SMS Terms

We may update these SMS Terms at any time. We will notify you of material changes by sending an SMS notification or by posting a notice on our website. Continued use of the Service after changes are posted constitutes acceptance of the updated SMS Terms.
