SMS Terms & Conditions
Effective Date: March 22, 2026 · Last Updated: April 14, 2026These SMS Terms and Conditions ("SMS Terms") govern the text message communications sent by HeyJessica ("we," "us," or "our") to you and your parent or family member as part of the HeyJessica daily check-in service. By signing up for HeyJessica and providing a phone number, you agree to these SMS Terms.

1. Program Description
HeyJessica uses SMS text messaging to deliver daily check-in messages to seniors on behalf of their enrolled family members. Specifically:
- To your parent (the senior): Daily morning check-in messages, friendly conversational follow-ups, and gentle reminders. These are the core of the HeyJessica experience.
- To you (the account administrator / adult child): Missed check-in alerts, weekly wellbeing summaries, usage notifications, and account-related service messages.
Messages sent to your parent are part of a family care coordination service — they are not marketing messages. Messages sent to you are transactional service notifications related to your active subscription.
2. How Consent Is Obtained
HeyJessica uses a two-step consent process to ensure direct opt-in from the message recipient:
Step 1 — Family member consent: The account holder (adult child) purchases a subscription at heyjessica.ai and completes an onboarding form. Directly above the form's submit button, the following consent language appears: "By submitting this form, you confirm you have your parent's permission to enroll their phone number and that they consent to receive SMS messages from HeyJessica. Message and data rates may apply. Reply STOP to opt out. SMS Terms: heyjessica.ai/sms-terms | Privacy Policy: heyjessica.ai/privacy-policy."
Step 2 — Senior direct opt-in: Immediately after the family member completes setup, a one-time opt-in SMS is sent directly to the senior's phone number. The message reads: "Hi [name]! My name is Jessica — [family member] asked me to reach out to say hello 💜 I'm going to be in touch to chat whenever you want — no schedule, no pressure. I'm just here for you. Reply YES to say hello, or STOP if you'd prefer not to hear from me. Msg & data rates may apply. heyjessica.ai/sms-terms"
The senior must personally reply YES before any further messages are sent. If the senior does not reply YES, no additional messages are sent. Consent is recorded at the time of the YES reply and linked to the senior's account record. Opt-out is available at any time by replying STOP.
3. Message Frequency
- Your parent: Typically one message per day as part of the companion check-in. Additional messages may be sent based on conversation activity or safety alerts. Message frequency may vary.
- You (administrator): Message frequency varies. You will receive alerts when your parent misses a check-in, when minute pools are running low, and for important account updates. You may receive multiple messages per day if alerts are triggered.
4. How to Opt Out
Your parent may opt out of receiving SMS messages from HeyJessica at any time by replying STOP to any message. Upon receiving STOP, we will send one final confirmation message and then cease all SMS communications to that number. You (the administrator) will be notified immediately that your parent has opted out, and daily SMS check-ins will be suspended.
You (administrator) may opt out of SMS notifications by replying STOP to any message or by updating your notification preferences in your account dashboard. Note that some critical account messages (such as billing notices) may still be sent by email even if you opt out of SMS.
To re-enable SMS messages after opting out, the senior may reply START to any previous message from Jessica at any time.

6. Message and Data Rates
Message and data rates may apply to all SMS messages sent and received as part of the HeyJessica service. These charges are applied by your mobile carrier and are not collected by HeyJessica. Contact your mobile carrier for details about your messaging plan.
7. Supported Carriers
HeyJessica's SMS service is available on all major US carriers including AT&T, Verizon, T-Mobile, Sprint, and most regional carriers. Carrier support is not guaranteed for all carriers. HeyJessica is not liable for delays or failures in message delivery caused by carrier issues.
8. Privacy
We do not sell, rent, or share your phone number or your parent's phone number with third parties for marketing purposes. Phone numbers are used solely to deliver the HeyJessica service and related service notifications. For full details see our Privacy Policy.
9. Changes to These SMS Terms
We may update these SMS Terms at any time. We will notify you of material changes by sending an SMS notification or by posting a notice on our website. Continued use of the Service after changes are posted constitutes acceptance of the updated SMS Terms.
