Terms of Service

Please read these Terms of Service ("Terms") carefully before using the HeyJessica website at heyjessica.ai or our AI companion service ("Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. About HeyJessica

HeyJessica provides an AI-powered companion service designed to support adults and their families through daily text and voice interactions, and to keep family members informed about their loved one's wellbeing. The Service is operated by Brave Digital Ventures, LLC, doing business as HeyJessica ("we," "us," or "our").

2. Eligibility

You must be at least 18 years of age to create an account and subscribe to the Service. By creating an account, you represent that you are 18 or older and have the authority to agree to these Terms.

When you subscribe on behalf of a family member, that family member personally enrolls in messaging and voice services through a separate web-based form. They enter their own mobile phone number, personally consent to receive SMS messages, and create their own user record. We do not send SMS messages or place voice calls to any phone number until the owner of that phone number has personally completed the enrollment process. 3. Accounts and Registration

To use the Service you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately via our contact page if you suspect unauthorized access to your account.

4. Subscription and Billing

Plans: HeyJessica offers subscription plans billed monthly. Current plans include the Companion plan and the Family plan. Pricing is displayed on our website at the time of purchase.

Founding Member Rate: Founding members lock in their founding rate at the time of subscription. The founding rate is guaranteed not to increase through December 31, 2027. After that date, standard pricing applies with advance notice. Founding member pricing is available to the first 500 subscribing families.

Billing start: Your payment method is charged at signup, and your subscription begins on the date of purchase.

Recurring billing: Your subscription renews automatically each month on your billing anniversary date. You authorize us to charge your payment method on file for each renewal period.

Cancellation: You may cancel your subscription at any time from your account dashboard. Your subscription will remain active through the end of the current billing period and will not renew.

Refunds: We do not offer refunds for partial billing periods, except where required by law.

5. Minute Pools and Overages

Each subscription plan includes a monthly pool of conversation minutes. Minutes are available for use throughout the month and reset on your billing anniversary date. If your enrolled family member exhausts the monthly minute pool, daily voice calls will be replaced with text check-ins at no additional charge. The account administrator will be notified when the pool is exhausted and given the option to purchase additional minutes.

Additional voice minutes are available at the per-minute rate displayed on our pricing page at the time of purchase. Optional SMS message add-ons are also available in tiered packages, displayed on the pricing page. Overage and add-on charges are billed separately and are not refundable.

6. The Service — What We Provide

HeyJessica provides:

• Daily AI-powered companion check-ins via text and optional voice call to your enrolled family member
• Memory and continuity across conversations so Jessica gets to know your family member over time
• Missed check-in alerts sent to the account administrator
• Weekly summaries of conversation topics and wellbeing indicators (Family plan)
• Real-time family nudges with the enrolled family member's consent (Family plan)

HeyJessica is not a medical service. We do not provide medical advice, diagnosis, or treatment. The Service is not a substitute for professional medical care, emergency services, or in-person supervision. If you believe your family member is in immediate danger, call 911 immediately.

7. SMS and Voice Communications

HeyJessica sends SMS messages and voice calls only to phone numbers whose owners have personally enrolled and consented through our web-based opt-in form. The account administrator does not provide consent on behalf of the recipient. Each recipient personally enters their own phone number and personally checks an affirmative consent checkbox before any communications are sent. Recipients may opt out of SMS messages at any time by replying STOP. If a recipient opts out, daily check-ins for that account will be suspended and the account administrator will be notified.

8. Conversation Privacy and Data

Conversation content between your family member and Jessica is stored to enable memory and continuity across sessions. We handle this data in accordance with our Privacy Policy. Jessica is designed to keep private conversations private and will ask your family member's permission before sharing personal moments with the account administrator. The only exception is alerts related to a genuine concern about your family member's immediate safety, which are sent to the account administrator without prior consent.

9. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to reverse engineer, scrape, or interfere with the Service
• Use the Service to harass, abuse, or harm any person
• Impersonate any person or entity
• Provide false information when creating your account or enrolling family members
• Enroll a phone number that does not belong to the person being enrolled
• Use the Service as a substitute for emergency services or medical care

10. Intellectual Property

All content, features, and functionality of the Service — including but not limited to the HeyJessica name, logo, website design, and AI conversation system — are owned by Brave Digital Ventures, LLC and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. WE ARE NOT RESPONSIBLE FOR THE ACCURACY OF AI-GENERATED CONVERSATION CONTENT.

HEYJESSICA IS NOT A MEDICAL DEVICE OR EMERGENCY RESPONSE SERVICE. DO NOT RELY ON THE SERVICE FOR EMERGENCY SITUATIONS. ALWAYS CONTACT EMERGENCY SERVICES (911) IN AN EMERGENCY.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HEYJESSICA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify and hold harmless HeyJessica, Brave Digital Ventures LLC, and our officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service, your violation of these Terms, or your violation of any third party's rights.

14. Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms. You may cancel your account at any time. Upon termination, your right to use the Service will immediately cease.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes by email or by posting a notice on our website. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

16. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the state or federal courts located in Los Angeles County, California.
